LICENSE AGREEMENT FOR ALBULA

This license agreement (the "License Agreement") is entered into between the person ("You") downloading, installing and/or using the software ALBULA (the "Software") and DECTRIS Ltd., Taefernweg 1, 5405 Baden-Daettwil, Switzerland ("DECTRIS"). By downloading, installing and/or using the Software, You agree to be bound by the terms and conditions of this License Agreement and to comply with its terms and conditions.

Copyright The Software, including without limitation its code, its documentation and its graphical user interface, is and shall remain the sole intellectual property of DECTRIS and may not be used for any purpose or in any way other than as explicitly allowed under this License Agreement.

License Terms Under this License Agreement, You may use the Software for its intended purpose free of charge. You may not use the Software in any way that exceeds the intended purpose of the Software as described in the respective documentation. You may not amend (including without limitation the amendment or deletion of logos, copyright information, the text of this License Agreement or similar actions), decompile, disassemble or reverse engineer the Software in any way. Furthermore, You may not interface the Software with any third party software (including software created by you or for you), except where such interfaces are provided by the Software, or combine the Software or integrate the Software into any second hand work in any way. You may not copy the Software or make the Software available to any third party in any other way. Notwithstanding the foregoing, You may make the Software available to other users of a multi-user system.

Registration In order to be able to download the Software, you are required to register with DECTRIS. DECTRIS shall not divulge your personal data to any third party except (i) where it is required by any applicable law to do so or (ii) where it needs to do so in order to prevent or defend against illegal activities.

No Warranties, Exclusion of Liability The Software is provided to You as is. No representations are made and no warranties (whether express or implied) are given by DECTRIS with respect to the Software. DECTRIS shall have no obligation whatsoever to provide support and/or maintenance with respect to the Software. DECTRIS, its affiliates, contractors, and suppliers shall under no circumstance be liable for any damages of any kind which arise as a result of the use of the Software or inability to use the Software, including (but not limited to) loss of profit, data corruption, expenditures, claims of third parties and savings that could not be realized.

Applicable Law and Jurisdiction This License Agreement is exclusively governed by Swiss substantial law. The courts of Baden, Switzerland shall have exclusive jurisdiction with respect to this License Agreement.
